Additionally, in markets with low inventory and high demand, sellers might find it easy to list and sell their properties without professional assistance. Online platforms and real estate websites have also made it simpler for individuals to list their homes, find buyers, and manage transactions without an agent. However, it's crucial to be aware of the potential challenges, such as legal complexities, marketing efforts, and negotiation hurdles, that can arise without professional assistance.

If you decide to FSBO, here is a list of some of the people with whom you must be prepared to negotiate:

  • The buyer who wants the best deal possible
  • The buyer’s agent who solely represents the best interest of the buyer
  • The buyer’s attorney (in some parts of the country)
  • The home inspection companies who work for the buyer and will almost always find some problems with the house
  • The termite company if there are challenges
  • The buyer’s lender if the structure of the mortgage requires the seller’s participation
  • The appraiser if there is a question of value
  • The title company if there are challenges with certificates of occupancy (CO) or other permits
  • The town or municipality if you need to get the COs or permits mentioned above
  • The buyer’s buyer in case there are challenges on the house your buyer is selling
  • Your bank in the case of a short sale

 

Real-Life Example: Why Do You Need a Real Estate Agent?

To illustrate the complexities that can arise in real estate transactions, consider a current lawsuit involving a friend of mine who is a lawyer. In this case, a "For Sale By Owner" (FSBO) seller is suing the buyer for backing out of the deal just days before closing. The twist? The seller discovered that the buyer had never placed the earnest money in an escrow account as required by the contract. Now, the seller is pursuing legal action not only against the buyer but also against the buyer's real estate agent for failing to ensure the earnest money was deposited per the agreement. The likelihood of the seller recouping liquidated damages for this contract is low. The kicker is that this seller tied up their home with the buyer before the big interest rate hikes of 2022 (that’s right, this lawsuit involves a situation that began almost two years ago). So, when the home was finally able to come back to market, it lost considerable equity due to mortgage rate hikes.

This situation underscores the critical importance of hiring a professional real estate agent. If the seller had hired a real estate agent, this costly oversight would likely have been avoided. An experienced agent would have ensured all contractual obligations were met, including the timely placement of earnest money in escrow. This case clearly demonstrates how a competent real estate agent can help prevent such costly legal disputes and ensure a smoother transaction process. By managing details and enforcing contract terms, a skilled agent protects clients' interests, saves them from potential pitfalls, and helps them navigate the often unpredictable real estate market.

 

Hiring a real estate agent can be incredibly beneficial in navigating the complex landscape of buying or selling a home. However, for those with sufficient experience and market knowledge, it might be feasible to handle transactions independently. Regardless of the path chosen, understanding the importance of adhering to all contractual terms is crucial to avoiding legal complications.
